Can Legislation Stop Deepfake Porn?

AI technology applies to more than just movies, search engines and software; crooks use thousands of people’s likenesses to create deepfake pornography, and there’s no simple way to stop it.
“One of the challenges is the people who create these could be hard to find, and even if it’s illegal, actually sort of getting that content addressed can be really difficult,” said UCLA professor John Villasenor.
“And then on the legislative side, of course, these bills have a very important goal, which is to reduce this very, very problematic use of this technology,” the professor told USA Today. “But one challenge is going to be that they may be subject to court challenges, not because people are opposed to the goal of addressing that particular way of using these technologies, but because sometimes, and I haven’t studied all the details of all the laws, but there’s a risk sometimes in technology regulation that you write a law that does address the problem that you’re trying to address, but it also has sort of collateral damage and other things, and be therefore can be open to some legal challenges.”

SEOUL, South Korea -- South Korea on Wednesday announced a package of steps to curb a surge in deepfake porn, saying it will toughen punishment for offenders, expand the use of undercover officers and impose greater regulations on social media platforms.
Concerns about nonconsensual explicit video contents that were digitally manipulated deepened in South Korea after unconfirmed lists of schools with victims spread online in August. Terrified, many girls and women removed photos and videos from Instagram, Facebook and other social media accounts, while others held rallies calling for stronger steps against deepfake porn.

A Science and Technology Studies Perspective

Abstract This paper analyses the current state of deepfake pornography from
a Science and Technology Studies (STS) viewpoint. Looking at the
phenomenon from a social constructivist perspective shows that
misogynistic power structures are embedded in certain deepfake
technologies and that deepfake pornography reflects and reinforces
such power structures. Additionally, the risk perspective points to
the need for effective (federal and global) legislation and to the need
for increased public awareness. Finally, the vulnerability perspective
reveals how not everyone is affected equally by the potential of being
featured in deepfake pornography, with celebrities having a higher
risk of being featured in deepfakes and private individuals experi-
encing greater difficulty disproving deepfakes of themselves. Impli-
cations and questions for future research are discussed.
